OLCC Rules Update: 2024 Hemp Implementation

At the October 17, 2024 Oregon Liquor and Cannabis Commission (OLCC) meeting, final action was taken by OLCC Commissioners to amend and adopt Oregon Administrative Rules implementing 2024 legislation and technical updates related to hemp.


These rules will go into effect on October 22, 2024.


The Updated OLCC Hemp Implementation Rules:

  • Detail regulations for artificially derived cannabinoids, including for CBN

  • Describe the application, denial, and revocation of industrial hemp grower certificate applications

  • Detail industrial hemp grower certificate privileges and prohibitions

  • Set definitions for the purposes of industrial hemp and hemp item testing

  • Detail how to order tests for industrial hemp and hemp items

  • Describe compliance testing requirements for industrial hemp and hemp items

  • Detail batch testing requirements for industrial hemp and hemp items

  • Set the scope, definitions, purpose, and effective date for hemp item concentration and

    serving size limits pursuant to ORS 571.309

  • Set the scope, definitions, purpose, and effective date for hemp item concentration and

    serving size limits pursuant to ORS 475C.257

  • Establish standards for approving industrial hemp products that contain artificially derived cannabinoids, including CBN and

  • Detail the procedures and requirements for presumptive marijuana testing of hemp crops


Securing New Authority for Updated Hemp Rules in Oregon

These rules were drafted following new statutory authority secured with the passage of HB 4121 in 2024, an effort led by our Chief Legislative Strategist Courtney Moran, and were guided by public comments.
